Terms and Conditions for Use of the Medcity LMS

These Terms and Conditions (“Terms”) govern access to and use of the Medcity Learning Management System (“LMS”, “Platform”) provided by Medcity International Academy (“Medcity”, “we”, “us”, “our”) to students enrolled in its training programmes, including but not limited to German language training, IELTS, PTE, OET, LanguageCert, TOEFL, GRE, dMAT, DHA, MOH, Prometric, DOH, CELPIP, and NCLEX-RN preparation courses.
By enrolling in a Medcity programme and receiving login credentials to the LMS, you (“Student”, “you”, “your”) agree to be bound by these Terms. Please read them carefully before using the Platform. If you do not agree with any part of these Terms, please contact Medcity’s administrative office before proceeding with LMS access.
1. Eligibility and Enrollment
- Access to the LMS is available only to students who have formally enrolled in a Medcity programme and completed the applicable admission and fee formalities.
- LMS access is granted on an individual basis. It is not transferable to any other person, whether or not that person is also a Medcity student.
- Medcity reserves the right to verify enrollment status at any time and to suspend access where enrollment details cannot be confirmed.
2. Account and Login Credentials
- Each student will be issued a unique username and password to access the LMS.
- You are responsible for keeping your login credentials confidential and for all activity that takes place under your account.
- Please inform Medcity’s administrative office immediately if you suspect unauthorised use of your account, so that access can be secured.
- Sharing of login credentials with another student, family member, or any third party is not permitted.
3. Course Access and Validity
- LMS access is granted for a minimum period of 6 (six) months from the date of enrollment. The actual validity period depends on the course and package the student has enrolled in, and may extend up to 1 (one) year or more for certain programmes, as specified at the time of admission.
- Access to course content, video lessons, mock tests, and study material is limited to the duration of the enrolled course and the validity period stated above.
- Extension of access beyond the validity period, where required, may be considered by Medcity on a case by case basis and may be subject to an additional fee.
- Medcity does not guarantee uninterrupted access to the LMS at all times, as access may occasionally be affected by maintenance, technical upgrades, or circumstances beyond our control.
4. Fees and Payment
- Course fees, including the portion attributable to LMS access, are payable as per the fee structure communicated at the time of enrollment.
- LMS access will remain active only for students whose fee payments are up to date. Access may be temporarily suspended in case of pending dues, with prior notice where practicable.
5. Refunds
Refund requests, where applicable, are handled in accordance with Medcity’s separate Refund Policy, which will be made available to students as a standalone document. These Terms should be read together with that policy.
6. Content Ownership and Permitted Use
- All course material available on the LMS, including video lessons, presentations, practice tests, notes, and any other content, is the intellectual property of Medcity International Academy or its licensors.
- Access to this content is provided to you solely for your personal learning and exam preparation, and only for the duration of your course validity.
- You may take personal notes for your own study purposes. Content should not be reproduced, resold, or used to create competing material.
7. Recording, Downloading, and Sharing of Content
The LMS is intended for personal, individual use. In the interest of protecting course content and maintaining fairness to all enrolled students, we ask that you observe the following:
- Please do not download, screen record, or make copies of video lessons or other LMS content, other than through any download feature we may officially provide within the platform.
- Please do not share your access, screen, or downloaded material with anyone who is not enrolled with Medcity for that course.
- If Medcity identifies repeated or deliberate misuse of course content, we reserve the right to suspend LMS access after informing the student and, where appropriate, discuss the matter with them directly.
We understand that occasional, incidental use for personal revision is a normal part of learning, and this clause is not intended to restrict genuine study activity. It exists to protect the effort that goes into producing this content for our students.
8. Code of Conduct
- Use of the LMS should be respectful and in keeping with the learning environment Medcity aims to provide.
- Any discussion forums, comment sections, or interactive features on the LMS should not be used to post content that is abusive, discriminatory, or unrelated to the course.
- Attempting to interfere with the technical functioning of the LMS, including through hacking, introduction of malicious software, or unauthorised access to other accounts, is strictly prohibited.
9. Data and Privacy
- Personal information collected during enrollment and LMS use, such as your name, contact details, and course progress, is used by Medcity for academic administration and communication purposes.
- Medcity will take reasonable care to protect student data and will not share it with third parties except where necessary for delivering the course (for example, official test registration bodies) or as required by law.
10. Technical Requirements
Students are responsible for ensuring they have a device and internet connection suitable for accessing the LMS. Medcity is not responsible for access issues arising from a student’s personal device, browser, or internet service.
11. Disclaimer
While Medcity makes every effort to ensure course content is accurate, current, and aligned with relevant examination formats (such as IELTS, OET, PTE, and NCLEX-RN), the LMS is a preparatory tool and does not guarantee any specific examination result or outcome. Success in any examination depends on multiple factors including individual effort and preparation.
12. Limitation of Liability
Medcity’s liability in connection with LMS access shall be limited to the fee paid by the student for the relevant course. Medcity shall not be responsible for indirect or consequential loss arising from temporary unavailability of the Platform or technical issues beyond its reasonable control.
13. Suspension and Termination of Access
- Medcity may suspend or terminate LMS access in cases of non-payment of fees, misuse of content, violation of these Terms, or on completion or discontinuation of the course.
- Where possible, students will be informed of the reason for suspension and given an opportunity to respond before access is withdrawn.
14. Changes to These Terms
Medcity may update these Terms from time to time to reflect changes in its courses, technology, or policies. Where changes are significant, we will make reasonable efforts to inform enrolled students. Continued use of the LMS after such updates will be taken as acceptance of the revised Terms.
15. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. Any disputes arising in connection with these Terms or use of the LMS shall be subject to the exclusive jurisdiction of the courts at Kannur, Kerala.
16. Contact and Grievance Redressal
For any questions, concerns, or grievances relating to LMS access or these Terms, students may write to Medcity’s administrative office at gm@miak.in.
By accessing the Medcity LMS, the student confirms having read and agreed to these Terms and Conditions.
